Alphyre - Terms of Service

Welcome to Alphyre, a CV assessment and candidate shortlisting platform that helps organisations streamline hiring. By accessing or using Alphyre, you ("User", "Recruiter", "Customer", or "Candidate") agree to be bound by these Terms of Service ("Terms").

Alphyre is a product of Data Circuit Ltd, a company registered in England and Wales (Company No: 14011058) with its registered office at 128 City Road, London, England, EC1V 2NX ("we", "us", "our").

1. Eligibility & Account Registration

• To use Alphyre, you must be at least 18 years old and have the authority to enter into binding agreements.
• Customers (e.g., employers, recruiters, HR teams) must provide accurate business information during account setup.
• You are responsible for safeguarding your account credentials.

2. Services Provided

• Alphyre provides tools for CV analysis, candidate scoring, first stage interviewing via audio and video calls, and shortlist generation.
• We may update, improve, or modify features at any time without prior notice.
• Availability is provided on an "as is" and "as available" basis.

3. Use of the Platform

You agree not to:

• Misuse the platform, attempt unauthorized access, or disrupt operations.
• Upload or process unlawful, discriminatory, defamatory, or harmful content.
• Use Alphyre for purposes other than legitimate recruitment.
• Copy, reverse engineer, or create derivative works from the platform.

4. Data & Privacy

• Customer and candidate data will be handled in accordance with our Privacy Policy.
• You are solely responsible for obtaining consent from candidates for the processing of their personal data.
• Data Circuit Ltd acts as a data processor for candidate data uploaded by Customers.
• We may anonymise and aggregate data for analytics and service improvements.

5. Subscription & Payment

• Access to Alphyre may be free, subscription-based, or subject to usage fees, as set out in the applicable plan.
• Payments are non-refundable except where required by law.
• Failure to pay may result in suspension or termination of access.

6. Intellectual Property

• All rights, titles, and interests in Alphyre (including trademarks, software, algorithms, and content) remain the property of Data Circuit Ltd.
• Customers retain ownership of any data they upload, subject to Alphyre's right to process such data for providing services.

7. Disclaimers

• Alphyre provides candidate scoring and recommendations but does not guarantee employment outcomes.
• Decisions made using Alphyre are the sole responsibility of the Customer.
• We do not verify the accuracy or authenticity of candidate-provided information.

8. Liability

To the fullest extent permitted by law, Data Circuit Ltd shall not be liable for:

• Loss of profits, business, or data,
• Indirect, incidental, or consequential damages.

Our total liability for any claim shall not exceed the fees paid by you in the 12 months preceding the claim.

9. Termination

• You may terminate your account at any time by contacting support.
• We may suspend or terminate your account for violations of these Terms, legal non-compliance, or misuse of the platform.
• Upon termination, your access ceases, but legal obligations (e.g., confidentiality, liability) survive.

10. Third-Party Services

• Alphyre may integrate with third-party tools (e.g., ATS, calendar systems).
• We are not responsible for failures or issues arising from third-party services.

11. Governing Law & Jurisdiction

• These Terms are governed by the laws of England and Wales.
• Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Amendments

• We may update these Terms from time to time.
• Continued use of Alphyre after updates constitutes acceptance of the revised Terms.
